Patent renewal is a mandatory procedure that needs to be adhered to after patent has been granted. This not just a procedure established by law but also a way to keep record of the existing patent by the by the patent and trademark office as per the Patent Act, 1970. As per the Act, patent is granted for a period of 20 yards after which it needs to get renewed. Section 53, Rule 80 of the Indian Patents Act provides for the provision of renewing patents on a daily basis after its grant. The renewal can be done at any time in 20 years.i.e. the life of the patent.


1) Payment made to the Indian Patent Office by making a patent renewal request.

2) Patent renewal fees having a range from Rs. 800 for individuals, Rs. 2000 for small entities and Rs. 4000 to Rs. 8000, Rs. 20,000 and Rs. 40,000 as standard renewal fees respectively.

The patent ceases to exist after 20 years. If the individual/entity wants to again obtain patent that has ceased to exist due to non-payment of renewal fees, it is suggested to go for restoration as per Section 60 Rule 84 of the Act and Patent Rules. This shall be done within 18 months of the lapse by filling Form 15 along with substantial evidence for such non- payment.
