Renewal of trademarks

A trademark is the unique identity of a business that helps its product and services standout from other products. It can be in the form of a photograph, logo, word or a combination of color and graphics. It is imperative to get these unique identities registered, as it is the ‘Intellectual Property’ of the business. Registering a trademark allows a company to protect their brand from trademark infringement. 

The Trademarks Act, 1999 was enacted by the Government of India to protect the users of trademark. It aims at protecting the trademark users and providing legal remedies if their rights are infringed. Trademark helps in identifying the true owner of the product/service; and it protects the trademark user from Trademark Piracy by preventing any unauthorized usage of it by anyone apart from the owners of the product/service. 

Why should you renew your trademark?

A trademark registration will be valid for a period of 10 years from the date of registration after which it has to be renewed. By renewing the trademark, the business will be able to enjoy those rights that are available only to a registered trademark. Failure to renew the trademark will result in losing all those rights and the protection that is obtained during registration. The Registrar of trademarks will send a notice to the trademark owner as a reminder regarding the expiry of the registration and conditions for the payment of fees.

If a business fails to renew its trademark, then the consequences are severe. If the application has not been filed for renewal or in case of non-payment of renewal fee the Registrar may remove the Trademark from the register. This will have an adverse impact on the licensees as well as the assignees of the trademark and will affect the legal rights of the company. Further, it will take away the exclusive rights of the business. Therefore, the most important benefit that the business will get by renewing its trademark is preventing other people from using their trademark.

Renewal Process and Forms:

  1. The application for renewal must be made in form TM-12 along with a prescribed renewal fee.
  2. The application can be made either by the trademark owner himself or any trademark agent.

Required documents:

  1. A copy of TM-1
  2. A copy of the registration certificate
  3. Power of Attorney
  4. ID proof of the applicant
  5. Address Proof of the Applicantion
