An application for change in particulars of copyright entered in the register of copyrights.

Copyright is an Exclusive Right given to the Owner or Author of an Intellectual Property. The Intellectual Property includes any literary, artistic, educational, musical, or any other form of Creative or Original Work. This right is given to the Owner or Author for a limited time and It protects the Right of the Owner or Author in case of any Infringement. A Copyright can be granted for original work created by the Owner by using independent thinking. The Copyright protection is not granted for ideas, techniques, etc a work must have the following key ingredients that are necessary for a work to qualify as an original work:

(i) Originality as per the expression of thoughts in writing.

(ii) Creative

(iii) Tangible. 

Who can apply?

  1. An aggrieved person by the entry made in the register of copyright.
  2. An aggrieved person, by an entry wrongfully omitted or entered or any defect entry on the register.
  3. Registrar of copyright upon his knowledge of wrongful entry or erroneous entry in the register of copyrights.

What changes are permissible?

Only errors can be corrected but the essence of the application cannot be changed. Few examples of what can be changed are:

  1. Change details of the publication and update details of publisher and subsequent publication.
  2. Details of persons authorized to license the rights of copyright.
  3. Details of owners of the various rights comprising the copyright.

Process of correction:

  • An aggrieved party may file a request for expunging of registration directly with IPAB (has the power to change entries in register), with all the available details and evidence.
  • The registrar of copyrights is required to provide documents supporting the entry made in the register of copyright.
  • The onus will lie on the aggrieved party to support the request/ reasons for making the changes in the register of copyright.

Documents necessary:

  1. Form -XV
  2. Original Power of Attorney, if filed through an attorney.
  3. Notarized copy of the Deed, if any.
  4. An affidavit attesting that there is no pending case under any court. Related to changes in registration.
  5. Notarized copy from Extract of ROC along with the works.
