Steps to get a patent in India

Granting a patent for your invention is a quite complicated procedure. As an investor, you need to follow certain mandatory steps to get patented in India, let us know each of them.

3.Filing of patent application

The filing of the patent application is the first step towards securing a patent for your invention. Filing a patent application is a relatively complicated process. As an investor, you need to act fast to defend your rights. Sometimes your application can be rejected; avoid these circumstances, you need to be very attentive in filing a patent.

4.Publication of patent application

One of the essential steps in the process of obtaining a patent Application is publishing. The date of publication holds a special Significance in the patent registration process because the Rights and privileges of the applicant begin on the date of Publication.

5.Request for examination

An application for a patent will not be examined unless the applicant demands an examination. The inventor can request for an examination of the application in the prescribed manner within the stipulated period. If no such request made, then the application shall be treated as withdrawn by the applicant.

6.Grant of patent

The Patent Office will grant a patent if the application fulfills all requirements as per the provisions of the act. However, the patent will be grant after the six months from the date of publication of the patent. Later patent name will be entered in the register of patents and notified in the official journal of the patent office. After the grant of patent each patent will be provided with the serial number by an electronic system, at the same time certificate of the patent is generated.
