THE NEED FOR REGISTRATION OF TRADEMARK

Before discussing the need for registration of a trademark, it is important to know what a trademark is. Trademark, is a type of intellectual property that is a recognizable sign, design, or symbol. It represents a particular brand name in the market, which helps in identifying and distinguishing that product from other products. For example, the trademark of AMUL is the little girl with AMUL butter on toast, now if one sees that symbol they can directly identify and connect it to AMUL. Now since trademark is directly related to the name and the goodwill of the company, it becomes extremely important to register it so that a third party is not able to use a trademark of your product, to endorse or promote their own product. These are signs, or symbols, or words, which can be legally registered and protected from being exploited by other people.

Trademark is an essential part of a business. It helps the company to communicate with the customers in a better manner since the company cannot directly interact with the consumers or the customers. It helps to catch the attention of the customers quickly. Innovative trademarks can help a business establish its identity different from others. It helps the consumer to remember your brand name easily by associating it with the trademark. It generates more goodwill and credibility in the market for your brand.

Now, because a trademark can make a huge difference to your business, it must be registered. It is to be noted that the trademark does not only protects your brand name from getting exploited by a third party, but it also helps the consumer to build up trust in the product. Consumers are attracted to products that have a unique identifier attached to them.  If the trademark you use is not registered, then you lose an essential right to sue the person who has misused your unique identifying tool. The use of a trademark by a third party can cause a huge loss of a company, concerning its goodwill in the market. When you register a trademark, you become the owner of that symbol, word, or sign and no one can access it without your permission. You claim an exclusive right over that trademark. However, it is to be noted that one cannot own a trademark for an eternity and the registration has to be renewed after the time period as given under law comes to an end.
