The private Hospital registration process  

There are two types of Hospitals viz. Government hospital and Private Hospitals. They could be further divided into general, specialty, or multi-specialty hospitals.  

The rules, regulations, and registration process for setting up a private hospital are listed below, 
 
Registration under the clinical establishment act, 2017 

Hospitals should fulfill the minimum requirement under the category in which it falls and follows the procedure of registration of the hospitals as per the state where the hospital is to be registered.  

Registration under Companies Act, 2013 

This act is for the hospital established under the ownership of a corporation.  
 

Director Index No for directors 

One-time, mandatory registration required for directors who want to be part of a corporation. 

 

Registration under the societies registration act, 2001 

The society registration act is applicable if the hospital is being established under the ownership of society,  
 

Locations of the Hospital 

The hospital should be set up in an area with fewer hospitals and in an area that has a good transportation facility, electricity supply, and water supply. These should be checked before purchasing any land for the hospital set up. 
 

Facilities Offered 

The facilities offered by the hospital should be decided by the hospital management based on the locality of the hospital. It may be generalized into pathology, ICU treatment; orthopedic, or any other specialized services should be specified. Also, the electricity, AC rooms, water, hygiene maintenance, etc., should be checked before providing any specialized services.  

Permits required for Hospital 
 

Land and construction 

A Hospital could be set up only on non- Agriculture land that could be used. The approvals and permissions needed from the local authority and the government should be obtained before starting any hospital. 
 

Electricity and water 

 The permission of municipal authority should be obtained for the water and electricity facilities. 
 
Sewage 

 
Planned sanitary measures for disposal of waste as well as drainage systems including tanks, pipelines, etc., and approval from the local authorities should be obtained. 
 

Biomedical Waste 

The Municipal corporation permission would be required for the disposal of waste and it must not be harmful to the people living at a nearby location. 
 

Regulations relating to Employment of Staff 

  • Background check of employees (Doctors, Nurses, Pharmacists) and following rules governing the employment of staff 
  • The safety of employees 
  • Rules governing the employment of staff 
  • The protection of staff from Occupational Health hazards. 

 
Sign Boards 
To follow rules for the size and place for signboards (IMC Regulations 2002) and display the below information at the Hospital: 

  • Certificate of registration of hospital with the local municipal authorities 
  • IMC/SMC registration certificate (IMC Regulations, 2002) 
  • Consultation charges along with other procedures/services (IMC Regulations 2002) 
  • Clinic timings, closed days 

 

Trademark registration 

Indian Trademarks Act 1999 is mandatory if the hospital wants to trademark its logo or name 
 

Vehicle registration for ambulances 

The hospital purchased ambulance should be registered under RTO, Transport Department, and state government. 
 

Planning the Hospital Infrastructure 

Some items related to planning are  

  • Qualifications of Doctors  
  • Working hours with shift timing for Nurses  
  • Medical equipment to be purchased 
  • Computers and hardware devices set up
  • Staff required for maintenance, plumbing, medical gas pipelines, and air conditioning.
