ESI Registration and Return Filing Procedure

ESI is an independent institution under the Ministry of Labour and Employment, Government of India. Employee's State Insurance (ESI) is a self-financing social security and health insurance scheme for Indian employees.

Who requires ESIC Registration?

ESI Registration is mandatory for every factory and specified establishments employing ten or more permanent employees, and wages of such employees are less than Rs. 21,000/- per month.

Penalty charged in case of failure to register ESI & ESI Returns

If there is any non-compliance by an employer, such as negligence to get ESIC employer registration online or non-satisfaction of the ESI return filing procedure, he shall be liable for a fine of INR 10,000/-.

Entities covered under ESIC

According to the government notification dated Sec 1(5) of the ESI Act, the following entities are incorporated:

1. Shops

2. Restaurants or Hotels only engaged in sales.

3. Cinemas

4. Road Motor Transport Establishments;

5. Newspaper establishments (not covered under the Factory Act)

6. Private Educational Institutions

Registration procedure

The procedure to be followed for the registration of the ESI:

a. Form No – 1 (Employers Registration Form) must be downloaded and filled.

b. After downloading its PDF version and filling the form, it is essential to submit it directly on the website, along with the required documents.

ESI returns are to be mandatorily filed bi-annually together with the following papers:

  • Register of attendance of employees
  • Register of wages
  • Form-6 register
  • Monthly returns and respective challans
  • Registration of any accidents that take place within the industrial or business premises.

What is the process after the form verification?

  1. After form verification, the government will issue a 17 digit unique number
  2. The employees who get registered under the ESI scheme will render the employer with the filled form. The photographs of his family members are necessary as a part of the procedure of registration. The employee will then get an ESI card after registration is complete
  3. ESIC gets intimated on any change in the Company or its employees 

How many returns are filed each year after the registration process?

After the registration, ESI Returns needs to be filed twice a year. The following documents are necessary for the filing of the returns:

1. Register of Attendance of the Employees

2. Form 6 – Register

3. Register of wages

4. Registration of any accidents which have occurred on the premises of the business

5. Monthly returns and challans
