ECOMMERCE, ITS TYPES AND PROVISION

The activity of buying and selling products online or over the internet. It usually uses the World Wide Web, at least for one part of the transaction cycle and even other technologies like an e-mail. Presently, the sector of Ecommerce in India has been witnessing an unparallel growth where the online shopping is open from the youngsters to the old generation. All the age groups prefer online shopping as it saves time and can be done in the comforts of our home. The new age technology is all what deserves the credit. Economic times, a Daily Newspaper has reported that the number of online shoppers in India had increased/observed a growth of 50 Million in 2015 and is expected to rise to 320 million by the year 2020.

There are two type of transactions in the sector of Ecommerce. Business to Business (B2B) and Business to Customer (B2C).

B2B (Business to Business) Ecommerce is the type of Ecommerce, where the transaction takes place between one business and another business. The prices in this transaction can vary at a very high scale. This is because the businesses which transact in such type of ecommerce are those which are very large entities and their volume of purchase and scale happens at a very large scale. The communication in this happens through an electronic medium. Some transactions include shopping or receiving orders, receiving invoice etc.

B2C (Business to Customer) is a type of Ecommerce which involves transactions between the Business and the public. This includes transactions of goods which can be tangible or intangible. In other words, this type involves selling through online portals.

The transactions in Ecommerce lead to the formation of E-contracts and the provision is under Section 10A of the Information Technology Act, 2008 (IT Act) this section states “the validity of any contract formed through this means and also lays down that the formation, communication and acceptance or revocation of such contracts shall not be deemed unenforceable only on the ground that such means or electronic form was used for the purpose mentioned above.”

Such a sector which is growing on an unprecedented basis must be guarded and hence appropriate laws have been formed.
