AVIATION LAW AND ITS LIBERALISATION

Aviation law is that branch of law that is concerned with air travelling and the associated business concerns. It is concerned with all legal issues which affect the aircraft, their navigation, the air traffic, etc. this law usually operates at federal level. Aviation law overlaps admirality law in some areas of its concerns. But in certain cases, aviation law is preferred or considered when it is a matter of international law.


The International Civil Aviation Organisation (ICAO) provides rules and mediates concerns in the international realm to all matters relating to aviation law. The ICAO is a specialised agency of the United Nations. In India, the Ministry of Civil Aviation (MCA) is responsible for the laws, policies, regulations related to aviation. While MCA oversees all planning related to aviation laws, there are authorities that work under the MCA. For example, the Directorate General of Civil Aviation (DGCA) is responsible for enforcing regulations; the Airport Authority of India (AAI) manages, upgrades and maintains infrastructure on air space as well as on the ground in India, etc. some of the key legislations are, the Aircraft Act,1934; the Aircraft rules, 1937; the Aircraft Corporations Act, 1953; the Carriage by Air Act, 1972 etc. Liberalisation of the aviation sector in India has led to many private players to enter the market and India has emerged as the ninth largest civil aviation market in the world during the Eleventh Five Year Plan which was implemented in the year 2007-2012. Overall, the Aviation industry has shown amazing and tremendous growth in the past decade. But however, for the industry to grow and earn sustainable profits, more reforms/amendments or guidelines necessary to be implemented and drafted and these additions/amendments must be in par with other jurisdictions. At present, there are many tax laws which are affecting the growth of the industry and on order to provide an impetus to the aviation industry there must be a form of relaxation in the tax laws and rates. This form of relaxation will help in the betterment of the industry and also profitability in the long run for all Indian air carriers in the long run.
