REAL ESTATE ACT, 2016

In the year 2016, the parliament enforced and enacted the Real Estate (Regulation and Development) Act. This act was enforced to regulate the sector of Real Estate. This legislation fills a huge gap in the real estate sector of law which was unregulated. This act provides help to the helpless and frustrated buyers who are on the mercy of the amoral builders and the years of continuous legislation. This act has been welcomed by the consumers who have been stuck in the construction and completion of their real estate project. Before the commencement of this act, buyers took the recourse to the consumer forums under the Consumer Protection Act, 1986 (COPRA).

The Real Estate Act, 2016 comes as a saviour for many buyers who are innocent. Before the commencement of this act, the relationship between the buyer and builder or seller was based on the agreement signed between the two parties. This brought in many unwanted problems in the Real Estate Sector. For example, people without any proper qualification would call themselves builders and take up projects. In order to fill the gap in the regulation of this sector The Real Estate act was enforced. The Real Estate Act protects the buyers and reverses the unequal bargaining power. It helps the buyers to seek compensation along with interest.

However, there are some drawbacks and with the proper amendments and with speedy redressal this act will benefit both the parties and further objective of the same act.
