Copyrighting has been the saviour for all the creative minds from a very long time. From the times content was published in books and magazines, people were getting their amazing stories published in those hardcover books, paintings and artworks were only restricted to those canvases lying in the back of the beds the time has changed drastically. Writeups are now being posted on blogs, instagram and twitter; content is being posted on platforms like Tiktok and YouTube; artists are going all independent and going digital for all the talent they have up in their sleeves.
Now with going digital, the fear of being your work being stolen is more evident than ever. It’s because 10 years ago from now, the work whenever hit the street was properly copywritten gone through the proper process but now when the work hits internet on a click of a key the protection of one’s talent is in a fragile hand.
With the copyright act coming into existence in the late 50’s , society has changed a lot since then.
Section 63B of the Copyright Act, 1957 which came in place after an amendment says that : Knowing use of infringing copy of computer programme to be an offence.— Any person who knowingly makes use on a computer of an infringing copy of a computer programme shall be punishable with imprisonment for a term which shall not be less than seven days but which may extend to three years and with fine which shall not be less than fifty thousand rupees but which may extend to two lakh rupees: Provided that where the computer programme has not been used for gain or in the course of trade or business, the Court may, for adequate and special reasons to be mentioned in the judgment, not impose any sentence of imprisonment and may impose a fine which may extend to fifty thousand rupees.
The copyright act and the IT act somewhere down the line protect the digital rights but its nowhere properly mentioned and does the ambiguities creates failure to protection.Various international conventions have been made and just their applications aren’t brought in force.
